Introduction

This Privacy Policy (“Privacy Policy”) describes how CoHive LLC and its affiliates will gather, use, and maintain your Personal Information on the CoHive Platform. It will also explain your legal rights with respect to that information.

By using the CoHive Platform, you confirm that you have read and understand this Privacy Policy, and our Terms of Service (together referred to herein as the “Agreement”). The Agreement governs the use of the Platform. CoHive LLC will collect, use, maintain, protect and delete information consistent with the Agreement.

General Terms

In this Privacy Policy:

  • CoHive LLC may be referred to as "CoHive," “we,” “our,” or “us.”

  • We call anyone who has authorized use of the CoHive Platform a user.

  • CoHive’s Sites, Apps and related services, information and communications are collectively referred to as the “CoHive Platform.”

  • “Terms of Service” refers to our Service Policy, which can be found here. This Privacy Policy is incorporated into, and considered a part of, the Terms of Service.

Types of Information Collected

CoHive collects two types of information about our users: Personally Identifiable Information ("PII") and Aggregate Information.

Personally Identifiable Information (PII) Collected

CoHive collects certain personally identifiable information about you, including information that can identify, relate to, describe, be associated with you, or is reasonably capable of being associated with you (“Personal Information”). We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use certain products or services available on the Site. Examples of Personal Information that CoHive collects include but are not limited to:

  • If you're a user, Information may include your first and last name, postal address, telephone number, email address, graduation class, current college, major, minor, rental preferences, activities, interests, and photos. We require that you furnish certain information when you register an account with us in order to provide services through the CoHive Platform. For example, if you are a user, we collect your first and last name, email address, mobile phone number, your current college information and your zip or postal code in order to create and administer your CoHive account. 

If you are a landlord, we collect your first and last name, business name, address of business, email, mobile and business phone numbers, maintenance contact, and property information including address, photos, property details. Billing Data, including your payment instrument number (such as a credit or debit card number), expiration date, and security code as necessary to process your payments will be collected by a 3rd party processing vendor, example Stripe. When processing your payment the 3rd party vendor uses encryption technology including secure socket layer SSL in order to prevent your PII from being stored or interceptors. Additionally, your credit card information is never collected  or stored on our CoHive servers.

  • If you choose to report a rental incident about a landlord or property CoHive may use your PII and aggregate data to create and maintain a running log on the resolution of the issue and use of a CoHive facilitator. You voluntarily report information about the issue that needs to be fixed, the date and the time the report is made.  We may collect Information in any email or chat message containing information about the problem will be used in order to help us respond to your incident.

Security of Your PII

CoHive will take all reasonable steps to protect the personal information it holds about you from misuse, loss, or unauthorized access. You acknowledge that the security of online transactions you conduct using this website cannot be guaranteed. CoHive does not accept responsibility for misuse of, or loss of, or unauthorized access to, your personal information where the security of that information is not within CoHive's control. CoHive will seek to insure all 3rd party providers are contractually bound to protect any PPI that is shared with them

  • On our Platform you can be assured that your PII is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII. For example:

  • We may keep collected information indefinitely and use it pursuant to the Site’s Terms of Service and Privacy Policy or to comply with any applicable legal or ethical reporting or document retention requirements.

  • We limit access to PII only to specific employees, contractors, and agents who have a reasonable need to come into contact with your information. For example, we may provide members of our technical support team with limited access to your account in order to allow them to troubleshoot problems you may be having with the Site.

  • Additionally, we also employ a number of physical, electronic, and procedural safeguards to protect PII. Our secure servers are protected by industry-standard encryption, and our servers reside behind firewalls and employ high-level password protection.

  • Finally, access by you to your PII is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone.

  • In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents (such as Stripe). They receive the information needed to verify and authorize your credit card or other payment information and to process your order directly from you. CoHive does not receive or store your credit card information.

  • Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (i) there are security and privacy limitations inherent to the Internet which are beyond our control; and (ii) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

Aggregate Information Collected 

Aggregate Information: This refers to information that does not by itself identify a specific individual. 

We may automatically collect certain information when you use the CoHive Platform. The categories of information we may automatically collect and have collected, including in the last 12 months, are as follows:

  • Service uses Data, including data about features you use, pages you visit, chats and advertisements you view, portions of the CoHive Platform that you view and interact with, the time of day you browse, and your referring and exiting pages.

  • When you visit and interact with the CoHive Platform, CoHive may collect certain information automatically through cookies or other technologies, including, but not limited to, the type of computer or mobile device you use, your mobile device’s unique device ID, the IP address of your computer or mobile device, your operating system, the type(s) of internet browser(s) you use, and information about the way you use the Platform (“Device Information”). 

  • Location use Data, when you visit the CoHive Platform via a native mobile application, we may use, with your consent when required under applicable law, GPS technology (or other similar technology) to determine your current location in order to determine the city you are located in and display a relevant location map. We will not share your current location obtained in this manner with other users.

  • Cookies and similar technologies are described in our Cookie Policy , which sets out the different categories of cookies and similar technologies that the CoHive Platform uses and why we use them.

  • We may also collect, or our third party advertising partners may collect, certain Aggregate Information. For example, we may use your IP address to diagnose problems with our servers or software, to administer our Platform and to gather demographic information on the effectiveness of our QR codes. Our third party advertising partners may also provide us with aggregate and individual reports that will tell us how many ads were presented and clicked upon at our Platform. 

CoHive’s use of Information

We collect and use information for business and commercial purposes in accordance with the practices described in this Privacy Policy and for our legitimate business interests. Our business purposes for collecting and using information include:

  • To operate and make available the CoHive Platform. We use your data to connect you with other users to enable the posting of social content, roommate selection, chat, incident reports, and payment for certain services, in order to fulfill our contracts with users;

  • To analyze performance and improve CoHive Platform as necessary for our legitimate interest in improving the Platform to grow our business;

  • To contact you and deliver (via email, SMS, push notifications, or otherwise) transactional information, administrative notices, marketing notifications, offers and communications relevant to your use of the CoHive Platform, with your consent when required under applicable law, as necessary for our legitimate interests in proper communication and engagement with our users, and in promoting our business;

  • To provide you with customer support in order to fulfill our contracts with users;

  • For internal market research for our legitimate interest in improving the CoHive Platform to grow our business;

  • For troubleshooting problems for our legitimate interests in ensuring a safe and secure environment in which users can meet;

  • To assist users in the resolution of complaints and disputes between them, as necessary for our legitimate interests in facilitating good relations among users;

  • To enforce our Terms of Service and our legitimate interests in ensuring our Agreement is complied with; and

  • As otherwise set forth in the Agreement.

Interest-Based Advertising. Ads are a standard part of user experience on the Internet, and CoHive believes that targeted advertising enhances this experience. CoHive and affiliate third parties may use cookies and other technologies to place ads where they believe interested users will see them. 

For more information and to understand your choices regarding third-party ads, please see our Cookie Policy. Advertising and marketing is carried out as necessary for our legitimate interests in providing an engaging and relevant experience, promoting our services, and growing our business.

Analytics and Market Analysis. CoHive may analyze information (“Market Analysis”) as necessary for our legitimate interests in providing an engaging and relevant experience, and promoting and growing the Platform.

CoHive may use information to offer services to users who express an interest in these services, through a poll for example, or to users who can be presumed to have an interest based on results from our Market Analysis. We may do this as necessary for our legitimate interests in providing an engaging and relevant experience, promoting our services, and growing our business.

Cell Phone Numbers. CoHive may use your cell phone number to call or send you notifications, about Reported Incidents (with your consent where required by law), and to administer the Platform. If you would like more information about our policy, or how to opt out, please review our Terms of Service. You may be liable for standard SMS and per-minute charges by your mobile carrier. CoHive may also message you via push notifications (with your consent when required under applicable law), which you can opt-out of on your mobile device. Data rates may apply.

Call recordings. Calls to or from CoHive or its Third Party Agents may be monitored and recorded for the purposes of quality control and training. Such calls may contain Personal Information.

Information Sharing

We only share the Information we collect about you as described in this Privacy Policy or as described at the time of collection or sharing, including as follows:

  • Third Party Agents. We share information, including Identity Information, with entities that process information on our behalf for our business purposes. We contractually prohibit our Third-Party Agents from retaining, using, or disclosing information about you for any purposes other than performing the services for us, although we may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law.

  • To operate the CoHive Platform, including processing your transactions, we may share your Personal Information with our agents, representatives, vendors and service providers (“Third Party Agents”) so they can provide us with support services as follows:

  • Receipt, invoice, or support services;

  • Customer relationship management services;

  • Data analytics;

  • Marketing and advertising;

  • Website hosting;

  • Communications services;

  • Technical support;

  • Financial transaction fulfillment (in which we are currently supported by Stripe for eg, who processes your Personal Information in accordance with its own privacy policy) and related chargeback and collection services; and

  • To otherwise help us provide the CoHive Platform.

Partners. Some CoHive content may be "sponsored by" or "presented by" other companies. If you connect to the CoHive Platform through a co-branded version of our Platform or otherwise participate in one of our partner programs, we may share information about your use of the CoHive Platform with that Partner in order to offer the integrated platform and to evaluate the partner program. We may also share your Personal Information with our Partners in order to receive additional information about you, or in order to create offers that may be of interest to you. Please check such Partner’s privacy policy before revealing information about yourself. If you don't want these Partners to have your Personal Information, you can choose to not participate.

Matched Ads. We use Matched Ads by sharing personal information with another party or incorporating a pixel from another party into our own Sites, and the other party matching common factors between our data and their data or other datasets for advertising purposes. For instance, Google ads and Google Analytics Advertising Features. 

Legal Obligations. CoHive and our Third Party Agents may disclose your Personal Information or user Generated Content to courts, law enforcement, governmental or public authorities, tax authorities or authorized third parties, if and to the extent required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with CoHive’s legal or regulatory obligations; (ii) respond to a court order, warrant or subpoena; (iii) respond to a valid legal request relating to an investigation into alleged criminal or illegal activity; or (iv) respond to or address any other activity that may expose us to legal or regulatory liability.

CoHive reserves the right to disclose Personal Information from both private and public areas of the Platform in the absence of a court order, warrant, or subpoena, to the extent permitted by applicable law, if we are given reason to believe, in our sole discretion, that someone is causing injury to or interfering with the rights of users, the general public, or CoHive or its partners, parents or affiliates.

It is our policy to provide notice to users before producing their information in response to law enforcement requests unless (i) we are prohibited or otherwise constrained by law or court order from doing so, (ii) we have reason to believe the user’s account has been compromised such that the notice would go to the wrong person, or notice would otherwise be counterproductive or would create a risk to safety, or (iii) it is an emergency request and prior notice would be impractical (in which case we may provide notice after the fact).

Merger or Acquisition. CoHive reserves the right to share information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale, or any other type of acquisition or business combination of all or any portion of our assets, or transfer of all or a portion of our business to another business.

Public Areas. Your activated user profile on the CoHive Platform consists of information about you and may include information such as photographs, your interests, your housing needs, and other information, including your username (“Profile”). The information in your user Profile may be visible to all users and the general public on the platform. If you choose to post a Roommate listing or Group Listing on the CoHive Platform, the contents of such listing will be viewable to users on the Platform.

3rd Party 

We may provide your information, including contact information, to third-party organizations for their use in marketing or promoting products or services that they believe may be of interest to you based on your use of the Platform, such as moving-related services and renters’ insurance services.

Your Rights and Choices

You may opt-out of receiving promotional communications from us, including promotional communications related to the CoHive Platform, and request the removal of your Personal Information from our databases, or deactivate your account, by logging on to the Site or App and clicking on the Settings tab, or by contacting us through the platform.

  • Push Notifications. You have the option to receive updates and relevant offers via push notifications in your app. These notifications can be configured in the settings of your mobile device at any time.

  • Corrections to Profile. You have the right to access, update, and correct inaccuracies in your CoHive user profile at any time by logging in and clicking on the Settings tab. There, you can view, update, and correct your Account information.

  • So that we may protect the integrity of the CoHive Platform, there are certain pieces of information, such as your age, that you cannot alter yourself. For example, since children under the age of majority in their jurisdiction of residence are not allowed to register as users, we need to take reasonable measures to preserve the accuracy of our users' ages. You may contact us at info@CoHive.me if there is a need to make a correction to such data. Please see Section 12, Children, for more details.

  • Promotional Communications. In the event we initiate promotional communications, you can opt out of receiving promotional communications from CoHive via the Settings tab in your Profile. In addition, you can opt out of email marketing by clicking on the unsubscribe link in any message. You can opt out of promotional communications from CoHive sent via text message at any time by following the instructions provided in those messages to text the word "STOP". Please note that your opt-out is limited to the phone number used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. Even if you opt-out of receiving promotional communications, CoHive will continue to send you non-promotional communications, such as those about your account, transactions, servicing, or CoHive’s ongoing business relationship with you. If you receive unsolicited promotional communications from a CoHive domain, please let us know here.

Changes to this Statement

Notification of Changes: Any changes to this Statement will be posted on the Site in this location and this Statement will be identified as “Updated”. If we change how we use your personally identifiable information, we will notify you here, by email, or by means of a notice on our home page. Your continued use of the Site after such notice constitutes acceptance of such changes.

Children

The Site is not designed to be used by persons under 13 years of age. If you are under the age of 13, you are not permitted to use this Website. If we learn we have collected or received Personal Information from a child under 13, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@CoHive.me

For purposes of the CCPA, other state laws governing the collection and use of minors’ personal information, and the Children’s Online Privacy Protection Act (“COPPA”), the Site does not have actual knowledge that it collects, maintains, or sells the Personal Information of minors of any age.

Cookies

Depending on how you use our Platform, we will store cookies on your computer in order to collect certain aggregate data about our users and to customize certain aspects of your specific user experience. A cookie is a small data-text file which is stored on your computer that uniquely identifies your browser. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and your first name to welcome you back to our Platform. We may use cookies to perform tasks such as: monitoring aggregate site usage metrics, storing and remembering your passwords (if you allow us to do so), storing account and advertising preferences that you have set, and personalizing the Services we make available to you.

We may also use an outside advertising partner to display banner advertisements on our Platform. As part of their service, they will place a separate cookie on your computer. We and our third party ad server will collect and use Aggregate Information about you, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server and whether you responded to a particular ad. Other advertisers may also place banner ads on our Site in the same manner as above.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some aspects of the Site may not function properly if you elect to disable cookies.

We use the Google Analytics Advertising Features which includes AdWords remarketing services to advertise on third party websites to visitors of our Platform. Third-party vendors, including Google, use cookies to provide advertisements based on a user's past visits to various websites, including our website. This remarketing can be seen in the form of advertisements on Google search result pages and other sites in the Google Display Network. Any data collected will be used in accordance with our privacy policy and Google's privacy policy. The CoHive Platform may contain links to other sites. While CoHive encourages our business partners to adopt privacy policies and practices that build users’ trust and confidence in the Internet, CoHive is not responsible for the privacy policies or practices of third parties or any of the content of Web sites linked to the Platform or any third-party products or services offered through the Platform or as otherwise stated or inferred by law. Specifically, CoHive is not responsible for the content of 3rd party advertisers or their links that appear on the Platform.
